1. Agreement to Terms

By accessing and using the services provided by GAF Trading Pte Ltd (GIA Code: C005833), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and GAF Trading Pte Ltd, a general insurance agency registered and operating in Singapore.

2. Scope of Services

GAF Trading Pte Ltd operates as a licensed general insurance agency in Singapore, providing intermediary services for general insurance products. Our services are limited to general insurance solutions, excluding marine and credit insurance products.

2.1 Insurance Products and Coverage

We facilitate access to various general insurance products including, but not limited to:

  • Commercial property protection for business assets and facilities
  • Liability coverage for corporate and professional risks
  • Asset management protection solutions
  • Business interruption coverage
  • Corporate risk mitigation programs

2.2 Agency Relationship

GAF Trading Pte Ltd acts as an intermediary between clients and insurance providers. We do not underwrite policies directly but facilitate the arrangement of coverage through licensed insurance companies. All policy terms, conditions, and coverage details are determined by the respective insurance providers.

3. Client Obligations and Responsibilities

3.1 Disclosure Requirements

Clients are required to provide complete, accurate, and truthful information when applying for coverage. Material misrepresentation or non-disclosure may result in policy voidance or claim denial. You must:

  • Disclose all material facts relevant to the risk being covered
  • Provide accurate financial and operational information
  • Update us promptly of any changes in circumstances that may affect coverage
  • Maintain accurate records of all insured assets and operations
  • Notify us immediately of any incidents that may lead to claims

3.2 Premium Payment Obligations

Clients are responsible for timely payment of all premiums as specified in their policy documents. Payment terms are established at the time of policy issuance and may include:

Annual Payment:Full premium due at policy inception or renewal

Quarterly Installments:Premium divided into four equal payments

Monthly Installments:Premium divided into twelve equal payments

Failure to pay premiums by the due date may result in policy lapse or cancellation. A grace period of 30 days is typically provided, during which coverage remains in effect. However, specific grace period terms are determined by the insurance provider.

3.3 Risk Management Compliance

Clients must maintain reasonable risk management practices as required by their policies. This includes implementing appropriate security measures, maintaining property in good condition, and complying with all applicable safety regulations and standards.

4. Service Fees and Charges

4.1 Commission Structure

As a licensed general insurance agency, GAF Trading Pte Ltd receives commission from insurance providers for policies arranged. These commissions are typically included in the premium quoted to clients and do not represent additional charges to the client.

4.2 Administrative Fees

Certain administrative services may incur additional fees, which will be disclosed to clients prior to service provision. These may include:

  • Policy modification or endorsement processing fees
  • Duplicate document issuance charges
  • Specialized risk assessment consultation fees
  • Premium financing arrangement fees

4.3 Payment Methods

We accept payment through various methods including bank transfer, cheque, and electronic payment systems. All payments must be made in Singapore Dollars (SGD) unless otherwise agreed in writing. Payment instructions will be provided with each invoice or premium notice.

5. Policy Terms and Conditions

5.1 Policy Documentation

All coverage is subject to the terms, conditions, exclusions, and limitations specified in the policy documents issued by the insurance provider. Clients are responsible for reviewing all policy documentation carefully upon receipt and notifying us immediately of any discrepancies or concerns.

Policy documents typically include the policy schedule, policy wording, endorsements, and any applicable certificates. These documents constitute the complete agreement between the client and the insurance provider regarding coverage.

5.2 Coverage Period and Renewal

Coverage periods are specified in each policy document. Most general insurance policies operate on an annual basis, with renewal subject to underwriting review. We will provide renewal notices at least 30 days prior to policy expiration, subject to receiving renewal terms from the insurance provider.

Renewal is not automatic and requires client acceptance of renewal terms. Premium rates and coverage terms may be adjusted at renewal based on claims experience, market conditions, and changes in risk profile.

5.3 Policy Modifications

Requests for policy modifications must be submitted in writing and are subject to insurance provider approval. Modifications may result in premium adjustments, either increases or decreases, depending on the nature of the change. Common modifications include:

  • Changes to insured property or assets
  • Adjustments to coverage limits or deductibles
  • Addition or removal of coverage extensions
  • Changes to named insureds or additional insureds
  • Updates to business operations or activities

6. Claims Process and Procedures

6.1 Notification Requirements

Clients must notify GAF Trading Pte Ltd and the insurance provider immediately upon becoming aware of any incident that may result in a claim. Initial notification should include basic details of the incident, including date, time, location, and a brief description of what occurred. Detailed documentation will be required as the claim progresses.

6.2 Documentation and Evidence

Clients are responsible for providing complete documentation to support their claims. This may include:

  • Photographs or video evidence of damage or loss
  • Police reports or incident reports from relevant authorities
  • Repair estimates or invoices from qualified contractors
  • Financial records demonstrating loss or business interruption
  • Witness statements or third-party correspondence
  • Medical reports or professional assessments where applicable

6.3 Claims Assessment and Settlement

All claims are assessed by the insurance provider in accordance with policy terms and conditions. GAF Trading Pte Ltd will assist in facilitating communication between clients and insurance providers but does not have authority to approve or deny claims.

Settlement timelines vary depending on the complexity of the claim and the completeness of documentation provided. Simple claims may be settled within weeks, while complex claims requiring extensive investigation may take several months.

7. Cancellation and Termination

7.1 Client-Initiated Cancellation

Clients may request policy cancellation at any time by providing written notice to GAF Trading Pte Ltd. Cancellation requests must include the policy number, effective cancellation date, and reason for cancellation. Cancellation is subject to the terms specified in the policy documents.

Premium refunds for mid-term cancellations are calculated according to the insurance provider's cancellation provisions, which may be on a pro-rata or short-rate basis. Minimum retained premiums may apply.

7.2 Insurer-Initiated Cancellation

Insurance providers reserve the right to cancel policies in accordance with applicable regulations and policy terms. Common reasons for insurer-initiated cancellation include non-payment of premiums, material misrepresentation, or significant changes in risk that make coverage unacceptable.

Statutory notice periods apply to insurer-initiated cancellations, typically ranging from 7 to 30 days depending on the reason for cancellation and regulatory requirements.

7.3 Termination of Agency Relationship

Either party may terminate the agency relationship by providing 30 days written notice. Termination of the agency relationship does not automatically cancel existing policies, which will continue according to their terms with the insurance provider.

8. Limitation of Liability

GAF Trading Pte Ltd acts as an intermediary and is not liable for the solvency or claims-paying ability of insurance providers. Our liability is limited to the proper performance of our duties as an insurance agency, including accurate transmission of information and timely processing of documentation.

We are not responsible for:

  • Coverage decisions made by insurance providers
  • Claims denials based on policy terms or exclusions
  • Delays in claims processing by insurance providers
  • Adequacy of coverage limits chosen by clients
  • Losses arising from gaps in coverage not identified by clients

In no event shall GAF Trading Pte Ltd be liable for indirect, consequential, special, or punitive damages arising from our services or any errors or omissions in the provision of those services.

9. Confidentiality and Data Protection

9.1 Information Security

We maintain strict confidentiality regarding all client information and implement appropriate security measures to protect personal and business data. Client information is used solely for the purpose of providing insurance services and is shared only with insurance providers and other parties necessary for policy placement and administration.

9.2 Regulatory Compliance

Our data handling practices comply with Singapore's Personal Data Protection Act (PDPA) and other applicable regulations. We retain client records for the periods required by law and professional standards, typically seven years from the end of the business relationship.

9.3 Third-Party Disclosure

Client information may be disclosed to third parties including insurance providers, reinsurers, claims adjusters, legal advisors, and regulatory authorities as necessary for the provision of services or as required by law. We do not sell or share client information for marketing purposes without explicit consent.

10. Regulatory Compliance and Licensing

GAF Trading Pte Ltd operates under General Insurance Agency License C005833 issued by the Monetary Authority of Singapore (MAS). We are subject to regulatory oversight and comply with all applicable insurance regulations, including the Insurance Act and related regulations.

Our operations are conducted in accordance with professional standards established by the industry and regulatory authorities. We maintain professional indemnity coverage as required by regulation and participate in continuing professional development to ensure service quality.

11. Dispute Resolution

11.1 Complaint Procedures

Clients who have concerns or complaints regarding our services should contact us in writing at Support@gaftradingpte.com or by mail to our registered address at 515 Woodland Drive 14 #05-153, Singapore, 730515, Singapore. We will acknowledge receipt of complaints within 3 business days and provide a substantive response within 14 business days.

11.2 Escalation Process

If a complaint cannot be resolved through our internal procedures, clients may escalate the matter to relevant industry dispute resolution schemes or regulatory authorities. We will cooperate fully with any formal dispute resolution processes.

11.3 Governing Law

These Terms of Service are governed by the laws of Singapore. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the Singapore courts.

12. Modifications to Terms

GAF Trading Pte Ltd reserves the right to modify these Terms of Service at any time. Material changes will be communicated to clients via email or through prominent notice on our website at least 30 days prior to the effective date of changes.

Continued use of our services following notification of changes constitutes acceptance of the modified terms. Clients who do not agree with modified terms may terminate the agency relationship in accordance with the termination provisions outlined in Section 7.
